Ending the so-called "health tourism"
Ending the so-called "health tourism", comes into effect today PRE/1490/2012 Order of 9 July, which sets out rules for the application of Article 7 of Royal Decree 240/2007 of 16 February on entry, free movement and residence in Spain of citizens of the Member States of the European Union and other States party to the Agreement on the European Economic Area, published in the Official Gazette yesterday.
This new rule complements the regulation of RD 16/2012 on urgent measures to ensure sustainability of the Spanish NHS and improve the quality and safety of their services which came into force on 24 April and the transposition of a directive Europe in 2004 had not been completely collected by the Spanish legal system.
Article 3 provides that those not engaged in work in Spain but residing for more than three months, they must provide documentation of compliance with the following condition:
1 st. Insurance, public or private, contracted in Spain or another country, provided that provides coverage in Spain during their period of residence equivalent to that provided by the NHS.
Means, in any case, that pensioners meet this condition if credited by the relevant certification, who are entitled to healthcare under the State for which they receive their pension.
